1. Who we are and what these terms cover
- Libolink is a digital platform managed by Akhilesh Nigam, with the business address at Gorakhpur, Uttar Pradesh, India ("Libolink", "we", "us").
- These terms apply to library owners who register a library on Libolink ("you", "the Library") and to staff the owner invites.
- Students use Libolink through their library. Their relationship for membership and fees is with their library; how their data is handled is explained in our Privacy Notice.
- By creating a workspace or using Libolink, you accept these terms. You also accept the Privacy Notice, the Acceptable Use Policy, the Refund and Cancellation Policy and the Data Processing Addendum. If you accept for a business, you confirm you are authorised to do so.
- You must be at least 18 years old and legally able to enter a contract to register a library.
2. The service
- Libolink is software for running a self-study library. It covers students, seats, shifts, memberships, fee and deposit records, attendance (QR, location check and staff check-in), study sessions, notices, enquiries, reports, a student app and an optional public library page and directory listing.
- Features and limits depend on your plan. We keep improving Libolink and may change features. We will not remove a core paid feature during a period you have paid for without notice and a fair alternative.
- Libolink is a record-keeping and communication tool. It does not give legal, tax or accounting advice. It does not collect or hold your students' fee money (see section 5).
3. Accounts and security
- Give accurate registration details and keep them up to date.
- You are responsible for activity in your workspace, including what your staff do and the permissions you give them.
- Keep passwords private and use strong passwords. Tell us promptly at info@libolink.com if you suspect someone else has accessed your account.
4. Plans, trials and paying Libolink
- Plans, prices and limits are shown on our pricing page and in the app. Prices exclude GST unless stated; GST is charged as applicable.
- We may offer a free trial. To continue after a trial or a paid period, you need to pay for the next period. If we do not receive payment, the workspace may enter a grace period and then read-only access, as shown in the app. Your data is not deleted because of a missed payment while the account remains open.
- You can pay Libolink by UPI or bank transfer to the details shown in the app, which we verify manually, or online through our payment partner Razorpay. Libolink does not automatically debit your account; each renewal is a payment you choose to make.
- Refunds and cancellation follow our Refund and Cancellation Policy.
5. Student fees and payments to your library
- Students pay their fees to your library directly: in cash, to your UPI ID or QR, by bank transfer, or online where you enable it. Libolink does not receive, hold or settle these funds. We are not a party to the fee arrangement between you and your students.
- You are responsible for:
- your fee amounts, receipts, refunds and deposits;
- the accuracy of the UPI or bank details you publish;
- taxes on your income.
- A payment confirmation entered in Libolink (for example a UTR number or a screenshot) is a record submitted by a user. Check that the money has arrived before you approve it.
6. Your data and your students' data
- You own the data that you, your staff and your students put into Libolink ("Library Data"). You allow us to host and process it only to provide, secure and support the service, as set out in the Data Processing Addendum.
- For students' personal data, your library is the Data Fiduciary under the Digital Personal Data Protection Act, 2023. Libolink processes that data on your behalf as a Data Processor. You are responsible for:
- having a lawful basis, such as consent, for the data you collect;
- telling students what you collect and why;
- obtaining verifiable consent from a parent or lawful guardian for students under 18;
- responding to students' privacy requests.
- Libolink gives you tools to help with these duties: consent records, guardian consents, privacy requests and data exports.
- When you import students from a file, you confirm that the data was collected lawfully and is accurate. Opening balances and payment notes you import are your records.
- You can export your data at any time while your account is active and for 30 days after it ends. After that, we delete or anonymise Library Data as described in the Privacy Notice and the Data Processing Addendum, except where the law requires us to keep it.
7. Acceptable use
- Follow the Acceptable Use Policy. In short:
- no unlawful, harmful or misleading use;
- no spam;
- no attempt to break security or to access another library's data;
- no malware;
- messages you send to students must be lawful and relevant to your library.
8. Agents
- Libolink may work with independent agents who introduce libraries to us. An agent is not our employee. An agent cannot change these terms or prices, or make promises on our behalf.
- If an agent fills in your library details, you still choose your own password and accept these terms yourself.
- Report any agent misconduct to info@libolink.com.
9. Reviews and public pages
- We publish your rating or review on our website only with your explicit consent. You can withdraw consent at any time, and we then remove it. We do not publish invented reviews or statistics.
- If you publish a public library page or a directory listing, you are responsible for its accuracy and for having the rights to the images and text you upload.
10. Availability and support
- We aim to keep Libolink available at all times but cannot guarantee uninterrupted service. Where possible, we announce planned maintenance in the app.
- Support is available at info@libolink.com, Monday to Saturday, 9 am to 5 pm IST.
- The mobile app can keep some actions on the device while offline. Other actions need a connection.
11. Suspension and termination
- You may stop using Libolink at any time; see the Refund and Cancellation Policy.
- We may suspend or end access in any of these cases:
- a serious or repeated breach of these terms;
- non-payment after the grace period;
- a legal requirement;
- to protect users or the service.
- Where reasonable, we give notice and a chance to fix the problem first.
12. Intellectual property
- Libolink's software, design and brand belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service for your library during your subscription.
- We may use feedback you give us to improve Libolink, without any obligation to you.
13. Warranties and liability
- To the extent the law allows, the service is provided "as is" and "as available".
- Nothing in these terms limits liability that cannot be limited under Indian law. Subject to that:
- our total liability arising from these terms in any 12 months is limited to the subscription fees you paid us in those 12 months;
- we are not liable for indirect or consequential losses, for loss of profit, or for loss of data that you could have avoided by using the export features.
- You will indemnify us against third-party claims arising from your unlawful use of the service, or from Library Data you collected without a lawful basis.
14. Changes to these terms
- We may update these terms. For material changes, we notify owners in the app or by email at least 15 days before the change takes effect, and ask for acceptance where required.
- Using Libolink after the effective date means you accept the updated terms.
15. Governing law and disputes
- These terms are governed by the laws of India. The courts at Gorakhpur, Uttar Pradesh have exclusive jurisdiction, subject to any rights you have under consumer protection law.
- Please contact us first; most issues are resolved quickly.
16. Contact and grievances
- Support: info@libolink.com
- Grievance Officer: Akhilesh Nigam, info@libolink.com, Gorakhpur, Uttar Pradesh, India
